conditions of the MHP Knowledge Base
1. General
This website and all services offered via this website
constitute the MHP Knowledgebase.
The MHP Knowledgebase is offered to
the MHP community in order to assist the introduction and use of MHP content,
services and applications. For the time being [At least up the end of the year
2005], the on-line usage of the MHP Knowledgebase is free of charge.
The MHP
Knowledgebase is operated by the European MHP Knowledge Project.

Content, structure and design of the MHP Knowledgebase website and the
offered services are protected by intellectual property rights. The content and
services of the MHP Knowledgebase may
only be used as determined in this document.
3. Terms of
Use of MHP Knowledgebase content
A) Written
Documents / Publications
All written documents offered on the MHP Knowledgebase can be downloaded and
used and also further distributed as long as they remain unchanged.
If somebody wants to include paragraphs or even full
parts of our documents into his own commercial or non-commercial products, he
is allowed to do so free of charge but is obliged to make a reference to the MHP Knowledge Project and the MHP Knowledgebase website
(http://www.mhp-knowledgebase.org).
B) Source
Code
All source code available in the MHP Knowledgebase is OSI certified Open Source Software and can be
used under the terms of the GNU Lesser General Public License as published by
the Free Software Foundation; either version 2.1 of the License, or (at your
option) any later version.
Users who register for the MHP Knowledgebase have to accept these licence conditions.

C) Testing
of MHP applications
All on-line testing of MHP applications submitted by a
user of the website is offered free of charge and without giving a guaranty of
operation. Uploaded source code is not secure and can be accessed by other
users if it is not removed after testing.
4. User
input to the MHP Knowledgebase
The MHP
Knowledgebase includes areas that allow users to place information,
comments or materials (such as files of any type) and all users are welcome to
participate in the knowledge building process b contributing.
If users of the MHP
Knowledgebase contribute source code fragments, they agree that these
source code fragments can be further used under the terms of the GNU Lesser
General Public License as published by the Free Software Foundation; either
version 2.1 of the License, or (at your option) any later version. The copyright
holder of each code fragment is the contributing company or person. Care has to
be taken that all documents and code fragments in this area have a proper
copyright notice.
While the MHP
Knowledge Project does not control the inputs provided by users, it
reserves the right (which it may exercise at its sole discretion at any time
and without prior notice) to delete, move or edit the inputs and to terminate
the access to the MHP Knowledgebase.
Users comply to use the MHP Knowledgebase only for the provided purposes. For example, users
must not place spam, advertising, viruses and any kind of illegal or indecent
content. Users are solely responsible for the content of their inputs.
The collection, the processing and the utilisation of
personal information happens in each case only for the specified purpose. The MHP Knowledge Project keeps such data
confidential and stores them on secure servers.
Your personal data will NOT be handed on to third
parties and will NOT be used for the purpose of advertising.
All queries and access to the MHP Knowledgebase may be logged and registered for the purpose of
data protection, to allow for operational reliability and to protect against
possible attacks from outside.
6. Changes to the MHP Knowledgebase
and Termination of the Service
At any time, the MHP
Knowledge Project reserves the right, in its discretion, to suspend,
change, modify, add or remove portions of the MHP Knowledgebase available on the Site and/or to restrict the use
and accessibility of the Site.
The MHP
Knowledge Project may, in its discretion, terminate or suspend access (by
an individual or by all users) to all or part of the Site (including any right
to access and use the MHP Knowledge
Project) with or without cause.
7. Legal disclaimer, no warranty,
no indemnity
The MHP
Knowledge Project is not responsible for the content of user inputs and the
content of external websites that may be linked from within the MHP Knowledgebase.
Whilst every effort has been made to ensure the high
quality and accuracy of the Site, the MHP
Knowledge Project makes no warranty, expressed or implied, concerning the MHP Knowledgebase content, software,
products or services available through the site, which are provided "as
is". The MHP Knowledge Project
expressly disclaims all warranties, including but not limited to warranties of
fitness for a particular purpose and warranties of merchantability. In no event
will The MHP Knowledge Project, its
member organisations or other suppliers be liable for direct, special,
incidental, or consequential damages (including, without limitation, damages
for loss of business profits, business interruption, loss of business
information or other pecuniary loss) arising directly or indirectly from the
use of (or failure to use) or reliance on the Site Services, even if The MHP Knowledge Project has been advised
of the possibility that such damages may arise.
The MHP
Knowledge Project is making best effort to ensure that the content of the
MHP Knowledgebase is free from royalties, property rights or any other claims hold
by third parties. However, no warranty is made by the MHP Knowledge Project to the effect that the MHP Knowledgebase content is free from any claim or infringement of
any patent, utility model or any other intellectual property rights of any
third party.
The MHP
Knowledge Project does not guarantee the accuracy, content, or timeliness
of the Site Services nor their freedom from viruses or other contaminating or
destructive properties.
The MHP
Knowledgebase is made under and construed according to German Law.
